DWI / DUI Penalties in New Jersey
vary depending on whether you have previously been convicted
of DWI / DUI, the level of your blood alcohol level (BAC) and
particular specific circumstances relating to you personally.
FIRST DWI / DUI offense
If this is your FIRST DWI / DUI
offense in New Jersey, and you are convicted with a BAC of at
least .08% but less than .10%, your drivers’ license will be
suspended for 3 months, you will be required to pay a fine of
between $250 and $400, you will have to attend between 12 and
48 hours at an Intoxicated Driver Resource Center (IDRC), pay
fees and pay insurance surcharges of $1,000 a year for the
next three years. You could also, depending on the
circumstances, be required to spend up to 30 days in the
county jail.
If this is your FIRST DWI / DUI
offense in New Jersey, and you are convicted with a BAC of
.10% or higher, your drivers’ license will suspended for 7
to 12 months, you must pay a fine of between $300 and $500,
attend between12 and 48 hours at an Intoxicated Driver
Resource Center (IDRC), pay fees and insurance surcharges of
$1,000 a year for the next three years, and you could,
depending on the circumstances, be required to spend up to 30
days in the county jail.
SECOND DWI / DUI offense
If this is your SECOND DWI /
DUI offense in New Jersey within 10 years of the first offense,
your drivers’ license will suspended for at least 2 years,
you must pay a fine of between $500 and $1,000, attend between
12 and 48 hours at an Intoxicated Driver Resource Center (IDRC),
pay fees and insurance surcharges of $1,000 a year for the
next three years, and you could, depending on the
circumstances, be required to spend not less than 48
consecutive hours and not more than 90 days in the county
jail.
THIRD DWI / DUI offense
If this is your THIRD DWI / DUI
offense in New Jersey within 10 years of the second offense,
your drivers’ license will suspended for 10 years. In
addition, you must pay a fine of $1,000, attend between 12 and
48 hours at an Intoxicated Driver Resource Center (IDRC), pay
fees and insurance surcharges of $1,500 a year for the next
three years, and you could be required to spend 180 days in
the county jail.
